This website is operated by Emil Shoes ("we," "us," "our"). By visiting this site or placing an order, you agree to these Terms of Service and to our Privacy policy, Return and refund policy, and Shipping policy, each of which is part of these terms. If you don't agree, please don't use the site.

We may update these terms at any time by posting a revised version on this page. Continuing to use the site after a change means you accept it. Please check back periodically.

Using the site

You must be at least the age of majority in your state to use this site or to make a purchase. You agree not to use the site for any unlawful purpose, to violate any law or regulation, to infringe anyone's intellectual property, to transmit malicious code, to scrape or harvest data, or to interfere with the security or operation of the site. We may terminate your access for violating these terms.

Products, sizing, and availability

We sell closeout and overstock footwear. Stock is limited, sizes and widths sell out, and items are not restocked — availability shown on the site can change between the moment you view a page and the moment you check out. We may limit quantities per order, per person, or per address, and we may discontinue any product at any time.

We try to display colors and product images as accurately as possible, but we can't guarantee that your screen shows a color exactly as it is. Sizing and width information is provided by the manufacturer and may vary between brands and lasts. If a pair doesn't fit, our 30-day free return policy has you covered.

Accuracy of information

We work to keep descriptions, specifications, and prices accurate and current, but the site may occasionally contain errors, inaccuracies, or omissions. We reserve the right to correct them and to change or update information at any time without prior notice. No specified update date on the site means that all information has been modified or updated.

Orders, pricing, and payment

All prices are in U.S. dollars and are subject to change without notice. Your order is an offer to buy; a confirmation email is an acknowledgement that we received it, not acceptance. We may refuse or cancel any order, including after a confirmation has been sent — for example, if an item is out of stock, if a price or description was listed in error, or if we suspect fraud. If we cancel an order you've paid for, we refund you in full.

If an item is listed at an incorrect price, we may cancel the order and refund you rather than honor the error. Applicable sales tax is calculated and shown at checkout. You agree to provide current, complete, and accurate purchase and account information for every purchase.

Returns, cancellations, and shipping

Orders can be cancelled at no charge any time before they are fulfilled. Returns are accepted within 30 days of delivery, with free return shipping and no restocking fee, on unworn footwear in its original box. Full details are in our Return and refund policy and Shipping policy.

Third-party links and services

This site may link to or include material from third parties. We are not responsible for third-party content, websites, products, or services, and we don't warrant them. Review a third party's own policies and terms before you transact with them. Complaints or questions about a third party should be directed to that third party.

Your submission of personal information through the store is governed by our Privacy policy.

Disclaimer of warranties

We do not guarantee that your use of the site will be uninterrupted, timely, secure, or error-free, or that any results obtained from it will be accurate or reliable. Except as expressly stated by us, the site and all products and services delivered through it are provided "as is" and "as available," without any warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing here limits any manufacturer warranty that comes with a product, or any right you have under applicable consumer protection law.

Limitation of liability

To the fullest extent permitted by law, Emil Shoes and its owners, employees, and suppliers will not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the site or any product purchased through it. Where liability cannot be excluded, our total liability is limited to the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow these exclusions, so they may not apply to you.

Indemnification

You agree to indemnify and hold harmless Emil Shoes and its owners, employees, and suppliers from any claim or demand, including reasonable legal fees, made by a third party arising out of your breach of these terms or your violation of any law or the rights of a third party.

Severability and entire agreement

If any provision of these terms is found to be unlawful or unenforceable, that provision is severed and the remaining provisions stay in force. These terms, together with the policies posted on this site, are the entire agreement between you and us regarding your use of the site, and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of it.

Governing law

These Terms of Service, and any separate agreements by which we provide you services, are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules.
